    Hoya Surgical Optics: Terms and Conditions for IOL Sample Issuance, Version 1.0, October 2024
      

    1. Free of Cost: Any intraocular lens (IOL) samples issued by HOYA Medical Singapore Pte. Ltd.  and its affiliates* (“HSO”) for product evaluation purposes are provided free of charge. Under no circumstances should these samples be sold or charged to patients.
     

    2. Product Evaluation: The IOL samples are intended solely for the purpose of clinical evaluation and assessment by healthcare professionals. The feedback from these evaluations is crucial for the continued development and improvement of our products.
     

    3. Prohibition of unfair monetary benefit: The IOL sample shall not be used by any healthcare professional to gain unfair monetary benefits, such as through charging the patient or claiming reimbursement from third parties (e.g., public or private health insurance providers).
     

    4. Feedback Requirement: As part of the evaluation process, healthcare professionals are expected to provide feedback on the performance and efficacy of the IOL samples, following the format provided by HSO. 
     

    5. Regulatory Compliance: All healthcare professionals and healthcare organisations receiving IOL samples shall ensure that their use complies with all applicable laws, regulations, and professional standards.
     

    6. Limitation of Liability: HSO shall not be liable for any damages, losses, or claims arising from the misuse of the IOL samples provided for evaluation.
     

    7. Proper Storage and Handling: Sample recipients are responsible for ensuring that the IOL samples are stored and handled according to HSO's guidelines to maintain product integrity and efficacy.
     

    8. Non-Transferable: The IOL samples are non-transferable and must be used only by the healthcare professional or healthcare organisations to whom they were originally provided.
     

    9. Return of Unused Samples: Unused IOL samples must be returned to HSO upon request, unless otherwise agreed in writing.
     

    10. Consent to Use of Feedback: By providing feedback on the IOL samples, healthcare professionals consent to HSO using this feedback for research, development, and marketing purposes, provided that such feedback is anonymized to protect patient confidentiality.
     

    11. Acceptance of Terms: By accepting the IOL samples provided by HSO, healthcare professionals and healthcare organisations agree to adhere to these terms and conditions.
     

    12. Distributor Compliance with Terms & Conditions: All distributors of HSO products are expected to adhere to these terms and conditions for sample distribution. 
     

    13. Modification of Terms: HSO reserves the right to modify these terms and conditions at any time. Any changes will be communicated to the recipients.

    * For the purpose of these Terms and Conditions, “affiliates” shall mean any company or business entity that controls, is controlled by, or is under common control with HOYA Medical Singapore Pte. Ltd.
